The Amnesty law in 2016 came into force in Ukraine. It was published in the official edition Golos Ukrayinyon September 6.
This law provides an amnesty for people convicted for the commitment of the intentional minor offenses and crimes of average gravity; negligent crimes that are not grave and committed by people of such categories:
- people who were underage at the moment of crime commitment;
- currently pregnant women;
- parent of the underage children or disabled children (if they are not deprived of parental rights);
- people who are admitted as the disabled;
- people who reached the retirement age;
- veterans of war;
- participators of Chernobyl disaster elimination;
- children of the parents that are older than 70 years or disabled parents (if they do not have other children).
The action of the document spreads on the participators of the armed Donbas Conflict.
If the convicted serves sentence for minor offense or crime of average gravity then this person can be released if at least half of the main prison term is served.
The convicted of crimes of average gravity will get the shortened in a half prison term that they have to serve if they are not a part of the list of people who can be pardoned.
The decision of the application or non-application of the amnesty is made by a court individually towards every person after the careful examination of the identification record and information about the behavior of the prisoner while serving the sentence, the law said.
The President of Ukraine Petro Poroshenko signed the Amnesty law in 2016 by the request of the leaders of the churches and Heroes of Ukraine.
